Then Garotinho's defense dropped the appeal filed against the minister's decision. According to Rio Electoral Justice decision, Garotinho is ineligible for having been sentenced for intentional act of administrative misconduct in 2018. If the withdrawal request is accepted, Garotinho's votes could be definitively voided. With this, a new vote totalization will be determined, and the Rio de Janeiro Regional Electoral Court (TRE-RJ) could declare Douglas Ruas elected in the first round. With the new count, Ruas will obtain more than 50% of valid votes, excluding white and null votes, main rule for a candidate to be declared winner in the first round. Ruas obtained 4,271,199 votes, equivalent to 49.27% of valid votes, and Eduardo Paes (PSD) achieved 3,706,984 valid votes (42.76%). Garotinho received 274,411 votes (3.17%). His name remained on the ballot because the TRE-RJ decision barring the candidate was taken after the electronic ballot system closed.
